I think you're close.
It's not that you can't fly it (in this case). It's that you have to
get a permit first.
During the first Gulf war, there was a lady in Florida who had two sons
serving in the Gulf. She was flying an American flag on her property to
honor both of her sons.
She got a letter from the homeowner's association telling her that she
had to take the flag down because she was only allowed to fly it on certain
days that had been set aside for that purpose by the homeowner's
association.
The American Legion and the VFW went ballistic when they heard about it.
They had a protest march down the middle of that subdivision. The national
news media was there filming the whole thing.
Those veterans stood at attention and saluted as that lady brought her
flag out from the house and hoisted it up onto her flagpole. It was a
magnificent moment and I wish I could have been there.
She never heard from the homeowner's association on the matter again.
